What is Proprietary Food? What are the FDA Regulations?


Food Safety and Standard Authority of India, categorized the foods and beverages into two types, they are

  • Standardized foods – this kind of foods which can be processed and manufactured under the certain regulations, like biscuits, fruit drinks, fruit jam. Along with food business operator has a legal license to manufacture and compiles the products as per standard regulations given in the rules and act.

  • Non-standardized foods (proprietary food) – shortly, these foods are not standardized under any regulations, and contains the basic ingredients, generic additives. Proprietary foods are normal food products, until no existence of standards in FSSAI regulations. This can be manufactured from the standardized products like raw materials, cereals, grains, milk, vegetables, fruits, etc. Some instant products of this are tea, noodles, upma, chips, and so on, has been developed many more like this recently.

Delineation of Proprietary food

According to FSSAI, Proprietary food is an article of food that has been non-standardized under some regulations, which is not included of novel foods, special food for dietary uses, special food for medical purposes, also other food articles and the Central Government may notify in this behalf.

In addition, nutraceuticals, health supplements such as fortified foods were not been considered as a proprietary food in the new guideline mentioned by FSSAI.

Regulations of Proprietary food

  • Ingredients - Proprietary food must contain only mentioned ingredients other than the additives for the particular product, and some ingredients may be specified by the authorities from time to time. It also comprised of vitamins and minerals in noted quantity but not to exceed RDA of the respective micronutrients.

  • Additives - The level of additives in proprietary food must be used in a denoted quantity, as mentioned for the category or sub-category these Regulations in FSSAI, to which food belongs. This kind of category or sub-category shall be noted as on the label along with the generic name, nature and composition of the proprietary food.

  • Microbiological components - The microbiological components of proprietary food should be compiled as specified in the FSSAI Appendix. If microbiological component doesn’t mention for any proprietary food in the Appendix of guidelines, that should be concluded as unsafe food for consumption.

  • The provisions, and Regulations should be applicable to the produced proprietary foods, made under the Food Safety and Standards Act 2006. The health claims on the proprietary foods should not be done, until the substantiated by adequate and scientific evidence.

  • Whole responsibility - The food business operator/manufacturer must be responsible for the safety and standard of proprietary food in the respect of human consumption. The variation in the quality parameters of standardized food, as mentioned in the Food Safety and Standard Regulations under the Food safety and Standard Act 2006, will not be qualified of resultant products as a proprietary food.
